Trubay Stayz Terms & Conditions

Welcome to Trubay Stayz. We connect guests and hosts in Kenya for short-stay rentals. By using our platform, you agree to follow these terms. Trubay Stayz is a Kenyan company, and our policies respect Kenyan laws (for example, the Tourism Act 2011 and related regulations) as well as global best practices. We aim to keep things clear and fair for everyone.

Roles and Responsibilities:

• Hosts list properties and must ensure they are safe, lawful, and accurately described. This means following Kenya’s tourism regulations – for instance, you need the proper license and must keep a register of guests as required by the Kenya Tourism Regulatory Authority. Hosts must maintain the property, honor bookings, and treat all guests respectfully (no discrimination based on race, religion, gender, disability, etc.). You should also follow any local rules (such as building rules or security regulations) and hold appropriate insurance.

• Guests book stays and must pay on time and follow the host’s house rules. Guests should provide true information when booking and use the property responsibly – no illegal activities (for example, Kenyan law forbids using a rental as a brothel). Guests should also respect neighbors and the host’s property. If there are problems (maintenance issues, damage, etc.), guests should contact the host or Trubay Stayz support promptly.

Bookings and Payments:
All bookings are contracts directly between guests and hosts. We facilitate secure payment processing. Prices are shown in Kenyan Shillings (or your chosen currency) and include any stated taxes or fees. Hosts must charge and remit any required taxes (such as VAT or tourism levies) according to Kenyan law. Payments are handled through trusted methods like M-Pesa or credit/debit cards. Refunds or chargebacks follow the Cancellation Policy below.

Accuracy and Fairness:
We encourage transparency to build trust. Hosts should provide truthful descriptions and clear photos. Guests should communicate clearly and ask questions if unsure. Both hosts and guests should leave honest feedback after each stay to help others. We do not tolerate discrimination – for example, Kenyan law makes it illegal for hosts to discriminate against guests based on protected traits. By keeping policies and expectations transparent, we reduce misunderstandings and foster a fair community.

Dispute Resolution:
If a conflict arises, please contact the other party first to try to reach a friendly solution. If that doesn’t work, our support team is here to help mediate. We have a structured resolution process and aim to handle disputes promptly, fairly, and transparently. Research on two-sided marketplaces shows that “clearer proactive dispute resolution strategies and equitable policies” are key to trust. We take this seriously and will listen to both sides. In all cases, we act in line with Kenyan law and platform rules.

Liability and Safety:
Trubay Stayz is an intermediary platform. Hosts own and manage their properties, and guests use them at their own risk. While we vet listings and encourage safe practices, we cannot guarantee the condition or safety of every stay. You should satisfy yourself that the accommodation meets your needs before booking. We recommend that hosts have proper insurance (homeowner or landlord policies) and that guests consider travel insurance for their trip. In all cases, both hosts and guests agree to use the service responsibly and indemnify Trubay Stayz against any claims arising from the stay, except where required by law.

User Accounts and Data:
To book or list, you must register for an account and keep your information up to date. Each account is for one individual (or business) only. You are responsible for your account security. We will handle your personal data according to our Privacy Policy below, in line with Kenya’s Data Protection Act (2019).

Changes and Termination:
We may update these terms from time to time. We will notify you of significant changes. If you violate these rules or Kenyan law, Trubay Stayz may suspend or terminate your account and listings.
